Lot no. 300
Pieter Brueghel d. J., um 1564 Brüssel – 1637/38 Antwerpen DER BAUERNADVOKAT Öl auf Holz, auf Leinwand übertragen. 74,5 x 104,2 cm. In teilebonisiertem Holzrahmen. I, S. 501, Kat. Nr. 489, dort die früheste bekannte datierte Version abgebildet. C. Currie and D. Allart, The Brueg[h]el Phenomenon, Paintings by Pieter Bruegel the Elder and Pieter Brueghel the Younger with a Special Focus on Technique and Copying Practice, Brüssel, 2012, Bd. II, S. 672. (1261883) (13) Pieter Brueghel the Younger, ca. 1564 – 1637/38 THE PAYMENT OF THE TITHES Oil on panel, transferred to canvas. 74.5 x 104.2 cm. In partially ebonized frame. Accompanied by an expert’s report by Dr Klaus Ertz, Lingen, 9 March 2021, who examined the painting on offer for sale in original and dated its creation to after 1616. This is one of the most famous compositions by Pieter Brueghel the Younger, with many known copies by his workshop and followers. At least 25 works of this popular motif by the artist’s own hand are known, of which the earliest dates to 1615. Brueghel’s workshop offered two different formats, of which the smaller measures ca. 55 x 87 cm. The painting on offer for sale here is part of the group of larger format paintings measuring ca. 76 x 123 cm (in this lot: 74.5 x 104.5 cm). In line with the workshop practices by Brueghel blueprints were probably used for both formats, which guaranteed exact replicas of compositions with attention to details as is typical for Brueghel. The documents, which are partly inscribed in French indicate the “lingua franca” as the language of law for documents in the Netherlands at that time. The composition may be a creation by Jan Brueghel the Younger himself or may be inspired by a work by Nicolas Baullery (1560–1630). The subject, which shows peasants presenting their produce to a lawyer sitting behind a table certainly has satirical intention – an engraving published by Paulus Fürst in 1618 points to the fact that lawyers were accused of corruption. (†) Provenance: Acquired by a previous owner in ca. 1985 at Midmar Castle, Aberdeenshire. From then on Perthshire until ca. 2012. Literature for comparison: Dr Klaus Ertz, Pieter Brueghel der Jüngere (1564-1637/38). Die Gemälde mit kritischem Oeuvrekatalog, Lingen 1988/2000, vol. I, p. 501, cat. no. 489, including illustration of earliest known dated version. C. Currie and D.
